Welcome to the Nubeprint CloudPrinting Suite Service or ZERO Service site (the “CPS Site”). Nube Print S.L. and/or its affiliates (“Nubeprint”) provides the CPS Site to you subject to the following terms of use (“Terms of Use”). By visiting the CPS Site, you accept the Terms of Use. Please read them carefully. In addition, when you use any current or future Nubeprint services, content or other materials, you also will be subject to the CPS Customer Agreement or Authorization to Share Data document or other agreement governing your use of our services (the “Agreement”).

When you visit the CPS Site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the CPS Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
All content included on the CPS Site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of CPS or its content suppliers and protected by international copyright laws. The compilation of all content on the CPS Site is the exclusive property of Nubeprint and protected by international copyright laws. All software used on the CPS Site is the property of Nubeprint or its software suppliers and protected by international copyright laws.
“Nubeprint” and “CloudPrinting” are trademarks of Nubeprint registered. All other trademarks not owned by Nubeprint that appear on this Site are the property of their respective owners.
One or more patents owned by Nube Print S.L. or its affiliates may apply to the CPS Site and to the features and services accessible via the CPS Site. Portions of the AWS Site may operate under license of one or more patents.
Nubeprint grants you a limited license to access and make use of the CPS Site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of Nubeprint. Unless otherwise specified by Nubeprint in a separate license, your right to use any software, data, documentation or other materials that you access or download through the CPS Site is subject to these Terms of Use and the Agreement.
Any unauthorized use terminates the permission or license granted by Nubeprint. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of the CPS Site, so long as the link does not portray Nubeprint, or its products or services in a false, misleading, derogatory, or otherwise offensive matter.
To access the CPS Site you need an account and a password that is provided to you by Nubeprint. Using this account you may also create new accounts and passwords to give access to your end-users. You are responsible for maintaining the confidentiality of your CPS accounts and passwords and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password, or the account or password of your end-users. Nubeprint reserves the right to refuse service or terminate accounts in its sole discretion.
CPS Site is delivered with a preset of printing devices models that can be monitored using CPS service. You may find out that a specific device model is not included. In such a case Nubeprint will automatically test it for MPS compliance and add it to the database. We will do our best to have the new model available in less than 7 days. Though in most of the cases the model will be available in just 24h, in some occasions it may take us longer; please understand that this is a critical process that guaranties that the printers of this model will be managed in the most efficient way, including filters of false alerts and level of supplies not available from the printer. During this phase the printer will remain available in your view of the system, but no alerts are generated and by no mean the info shown should be considered accurate. It is a must that CPS keeps receiving data from the printer in order to fully fine-tune the test. This process is at no charge for you.
You and your end-users may be permitted to upload certain data, text or other content (“Third Party Content”), as for example company names, employees names, emails and telephones, to the CPS Site. You acknowledge that you use any Third Party Content at your sole risk.
THE CPS SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING ANY SOFTWARE) AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THIS SITE ARE PROVIDED BY CPS ON AN “AS IS” AND“AS AVAILABLE” BASIS, UNLESS OTHERWISE SPECIFIED IN THE AGREEMENT. CPS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THIS SITE OR THE INFORMATION, CONTENT,MATERIALS, PRODUCTS (INCLUDING ANY SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE CPS SITE, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THIS SITE IS AT YOUR SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, NUBEPRINT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE EXCEPT FOR MONITORING PRINTERS. NUBEPRINT DOES NOT WARRANT THAT THIS SITE; INFORMATION, CONTENT, MATERIALS,PRODUCTS (INCLUDING ANY SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE CPS SITE; ITS SERVERS; OR E-MAIL SENT FROM CPS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CPS WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE CPS SITE OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE CPS SITE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT,INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN THE AGREEMENT. CERTAIN COUNTRY LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
This Agreement shall be governed by Spanish law. We and or you shall submit any legal questions that could arise in relation to the interpretation and fulfillment of this Agreement to the jurisdiction of the Courts of the city of Madrid, expressly waiving any other applicable jurisdiction.
Please review our other policies on the CPS Site. These policies also govern your visit to the CPS Site. We reserve the right to make changes to the CPS Site, policies, and these Terms of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
